These Terms of Sale ("Terms") govern your purchase of custom-made jewellery from Pieceunyq - F.Z.C ("Pieceunyq", "we", "us"), a Free Zone Company licensed by the Ajman Free Zone Authority under Licence No. 55111. By placing an order through our website you agree to these Terms. Please read them before you order, in particular clause 2.4 (how the quotation deposit is treated), clause 3 (Design and intellectual property), clause 5.2 (when an order can no longer be cancelled), clause 6 (Delivery, import duties and taxes, including clause 6.4 on refused or unclaimed deliveries) and clause 7 (Warranty, inspection and returns).
2.1 Our pieces are made to order. Ordering follows these steps: (a) you create a design and receive an indicative price estimate; (b) you request a quotation; (c) we provide a firm written quotation, valid for seven (7) days; (d) you place your order and pay; (e) we produce your piece to order; and (f) we deliver it to you.
2.2 The indicative price estimate is for guidance only. The price in your firm quotation is the price that applies to your order, provided you order within the quotation's validity period.
2.3 Quotation deposit. To receive a firm quotation for a design you submit, you pay a quotation deposit. The deposit amount is displayed to you before you pay (currently AED 100). We may change the deposit amount from time to time; a change applies only to deposits paid after it takes effect and never to a deposit you have already paid.
2.4 How the deposit is treated. The quotation deposit is a non-refundable quotation fee. If you place your order, the full deposit is credited against the price of your order, and your commercial invoice shows the full piece price with the deposit as a credit line. If you decline the quotation, do not proceed, or do not place an order, the deposit is forfeited. If we or our production partners cannot fulfil your quotation request and we decline it, the deposit is returned to your account as a quotation credit usable for a future quotation request; it is not refunded to your payment method. If you cancel your quotation request before work on your quotation has begun, the deposit is likewise returned to your account as a quotation credit usable for a future quotation request; if you cancel after work on your quotation has begun, the deposit is forfeited.
2.5 If we decline your design, your next quotation is free. Whenever we or our production partners decline your quotation request, you are not left out of pocket for it: what you paid comes back to your account as a quotation credit, so your next quotation request costs you nothing. This works the same way whether you paid a deposit for the declined request or used a quotation credit for it. A quotation credit can be used for any future quotation request and does not expire. It is credit toward a future quotation, not a refund to your payment method.
3.1 Content you provide. You keep ownership of any original design elements, artwork, text or monograms that you supply. You grant us a licence to use, copy, modify, store and adapt them, and to allow our manufacturing partner and our service providers to do the same, for the purposes of generating and refining your design, producing and delivering your piece, and showing our work. That licence is worldwide, perpetual, irrevocable, royalty-free and sub-licensable, and it continues after your order is complete. It includes processing by the artificial-intelligence providers described in our Privacy Policy. To the extent the law allows, you agree not to assert against us any moral right you hold in that content.
3.2 Designs created on the platform. The designs, renderings and CAD files created through the Pieceunyq platform for your order are our intellectual property. Your purchase entitles you to the finished physical piece, not to the design files, and not to any right to have the design reproduced elsewhere.
3.3 Your warranty. You warrant that any design, image, text, name, monogram or other content you provide or select is your own original creation, or that you are authorised to use it, and that it does not infringe the intellectual property or other rights of any third party. In particular, it must not incorporate any third-party brand name, trademark or logo, and it must not reproduce the distinctive design of an identifiable jewellery house.
3.4 Your indemnity. You agree to indemnify us against any claim, liability, loss or cost (including reasonable legal costs) arising from any breach of clause 3.3.
3.5 Our right to decline. We may decline or cancel any order where we reasonably consider that a design may infringe a third party's rights. If we decline an order before production begins, we will refund any amount you have paid for it.
4.1 Prices are in UAE Dirhams and are as stated in your quotation.
4.2 Pieceunyq is not currently registered for UAE Value Added Tax, and no UAE VAT is charged on your order. If we become registered for VAT, any VAT due will be shown separately in your quotation before you place your order. For import taxes and duties in your own country, see clause 6.
4.3 When you place your order, we authorise your card for the order amount. This places a hold on the funds. It does not charge you. We take payment only once the checks described in clause 9 are complete. If those checks are not completed, we do not take payment and the hold on your funds is released.
4.4 We accept payment by card through our payment provider. We do not accept cash.
4.5 Before we take payment we may need to verify your identity, and on some orders we may ask where your funds come from. What we ask for depends on the risk rating we give your order, and we always ask on an order at or above AED 55,000, whatever that rating. Clause 5.3 of our Privacy Policy sets out what each rating means for you and what we do with anything you give us.
5.1 Each piece is produced specifically for you. You may request changes before production begins. Changes may affect the price and the delivery timeframe.
5.2 Once we have confirmed your order and production has begun, the order cannot be changed or cancelled, and is non-refundable.
6.1 We will give an estimated delivery timeframe when you order. As each piece is made to order, timeframes are estimates and are not guaranteed.
6.2 Risk and title in the piece pass to you on delivery to you or to the address you nominate.
6.3 We ship from Dubai, United Arab Emirates. Import duties, taxes and customs clearance fees may be charged by the country your piece is delivered to. These are not included in our price, they are your responsibility, and they may be collected either before or at delivery.
6.4 If a shipment is refused, unclaimed, or returned to us because import charges have not been paid, any refund may be limited to the recoverable residual material value only, after deduction of design, manufacturing, shipping, return shipping, customs charges and other costs we cannot recover. In many cases, no refund will be due.
6.5 We are not responsible for delays caused by events outside our reasonable control.
7.1 Our warranty. We warrant your piece against manufacturing defects for twelve (12) months from delivery. The warranty period is stated on your invoice, and a warranty document is supplied with your piece. The warranty covers manufacturing defects. It does not cover normal wear and tear, accidental damage, misuse, loss, or work carried out on the piece by anyone other than us or a partner we have authorised.
7.2 Please check your piece on arrival. If your piece arrives damaged, or obviously differs from the final design you approved, please tell us within five (5) days of receiving it and send photographs showing the issue. Telling us promptly helps us establish what happened in transit, while the evidence is still available.
7.3 Defects that appear later. If a manufacturing defect appears during the warranty period in clause 7.1, please tell us within thirty (30) days of the defect appearing, and send photographs showing the issue. This applies whether or not the defect was visible when your piece was delivered. A defect that first appears after the warranty period has ended is not covered.
7.4 We need to see the piece. Before we can assess a claim under clause 7.2 or clause 7.3 we need the piece itself, together with any part that has come away from it. We will tell you how to return it, and we pay the cost of that return where the claim is valid. We cannot assess or remedy a piece we have not examined.
7.5 How we put it right. Where a claim under clause 7.2 or clause 7.3 is valid, we put it right at our cost. In almost every case that means repairing your piece and returning it to you. Where a repair would not restore the piece properly, we replace it. Clause 7.7 applies.
7.6 Stones. Where a stone comes away from its setting and you return the stone with the piece, and we find the setting was defective, we re-set the stone or replace the setting at no charge to you. A stone loosened or lost through impact, a fall, or catching the piece is accidental damage rather than a setting defect, and is not covered. The full list of what the warranty does not cover is in the warranty document supplied with your piece, and it is available before you order.
7.7 Your statutory rights. Nothing in these Terms affects the rights given to you by UAE consumer protection law.
8.1 We will provide your piece with reasonable skill and care and in accordance with the final design you approved.
8.2 To the extent permitted by law, our total liability in connection with any order is limited to the price you paid for that order, and we are not liable for any indirect or consequential loss.
8.3 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
We screen orders and customers against applicable sanctions and anti-money-laundering requirements. Your card is authorised when you place your order, but no payment is taken until those checks are complete. Where an order does not pass those checks, we do not take payment and the authorisation on your card is released. We may decline any order on this basis.
10.1 We may change these Terms. The version in force when you place your order is the version that governs that order, and a later change does not alter an order already placed. The current version is published on our website, with its version number and date.
11.1 These Terms are governed by the laws of the United Arab Emirates. The Courts of Dubai have jurisdiction over any dispute arising out of or in connection with them. This does not affect any right you have to bring a complaint to the UAE consumer-protection authorities.
